By using this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Capital Hair and Beauty’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

The term 'Capital Hair & Beauty' or 'us' or 'we' refers to the owner of the website whose registered office is Capital (Hair and Beauty) Ltd, Crowhurst Corner, Crowhurst Road, Brighton, BN1 8AP. The term 'you' refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

Trade only

Capital Hair & Beauty is a trade only supplier. By purchasing from us you are confirming that you are qualified in the hair or beauty profession and as such are competent in using the products sold on this website. We will not be held responsible for any injury or damages incurred by users of the products we sell. We reserve the right to ask for proof of professional status and to refuse to fulfill an order if we believe the person ordering is not a trade customer. As a business user, it is your responsibility to ensure that you are insured for products that you are using.

To shop in-store you'll need to prove you work and/or are qualified in the hair or beauty industry, ID will also be required.

Our stores will accept one of the following as proof:

  • Salon business card and a letter from solicitor or accountant
  • Third-party insurance certificate
  • Course completion certificate
  • Student enrolment letter, stating course dates
  • Trade reference or buying card from another hair and beauty trade supplier
  • Business cheque book or business credit card

Along with one of the following forms of identification:

  • Driving licence
  • Utility bill
  • Passport

The content of the pages of this website is for your general information and use only. It is subject to change without notice.

You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. Colours of products may vary greatly due to differences in camera/monitor settings; product packaging may also be different to that shown.

Product availability

All products are subject to stock availability. If there is insufficient stock to fulfill your order we may contact you (usually via email) confirming which item(s) are out of stock and if applicable give you an opportunity to cancel your order or have it part shipped. Items not shipped will need to be re-ordered, please click on 'email me when back in stock' to be notified when your item comes back into stock. We will not be obliged to offer compensation for any disappointment suffered.

Please be aware that clearance lines are often items that have been discontinued by the supplier, held in stock for an extended period of time and as such, may have imperfect packaging.

Product reviews

You must have registered and be logged in on our website to submit a review. We thank you for sharing your views with us and other customers. All reviews will be checked before they are posted to the site so please follow our guidelines.

  • Must be relevant to the product in question and not be related to your experience in buying or having the item delivered.
  • Must not contain derogatory comments directed towards other reviewers.
  • Must not contain content that might be considered unlawful, harassing, libellous, abusive, sexually gratuitous, threatening, harmful, vulgar, obscene, or otherwise objectionable material.

  • Must not contain personal information about anyone - including you - such as phone numbers, postal addresses or credit card numbers.
  • Must not be submitted by suppliers or manufacturers.

Student Club

To be eligible for a Student Club account, you must be actively in education within the hair & beauty industry. The use of your Student Club account and associated benefits are for your sole use and may not be shared with others or used to purchase items on behalf of others. Any offers, discounts or benefits are subject to a fair use policy and we reserve the right to amend or withdraw benefits at any time without prior notice.

We reserve the right to validate your student status with your college. Salon Furniture & Equipment, Training Courses, ghd, College Kits and Shipping are excluded from any discount or promotional codes. Introductory £10 gift voucher subject to £25 minimum spend and may not be used in conjunction with any other discount or offers. Any discounts or offers available with Student Club may not be used in combination with any other promotion.

 

Training courses

In these Terms and Conditions reference to ‘We’, ‘Us’ or ‘Our’ means Capital Hair & Beauty Ltd, where the training course is booked and attended in the United Kingdom. These Terms and Conditions shall apply to every training course booked at Capital Hair & Beauty Ltd to the exclusion of any other terms and conditions you may wish to rely upon. By booking a place on a course you are deemed to have accepted these Terms and Conditions.

Course Types

Online Course

You will be purchasing an Online Learning course from Capital Hair & Beauty Ltd. You will be contacted by the relevant training provider once your booking has been processed, so by purchasing your course from us you are agreeing to the provider sending you the relevant online learning material.


In-store Course

You will be purchasing an In-store/Face to Face Learning from Capital Hair & Beauty Ltd. Your booking will be confirmed by email.

We reserve the right to decline applications. All courses require a minimum number of at least two students for the course to run.

Some of our In-store courses also give you online portal access to training material.  This will be emailed to you approximately 7 days prior to your course. This allows you to have a look if you wish, but the educator will go through with you on the day of the course. By purchasing your course from us you are agreeing to them sending your online learning material to you.

We reserve the right to decline applications.


Course Fees

Course fees are correct at the time of publication and exclude the cost of products required for the course unless expressly stated. We reserve the right to vary the course fees from time to time without notice to you.


Payment

Payments must be made in full at the time of the booking. For online courses, payments are non-refundable. For both blended and in-store courses, payments can be refunded if you notify us you are cancelling your place on the course at least 8 days prior to the course date. After this time all course payments are non-refundable and non-transferable.


Course Content

We will endeavor to cover all the topics outlined in the relevant section of the Course Information Sheet. We have the right to make any changes to the course content which are necessary to comply with any changes to industry best practice, any applicable law or safety requirement, or which do not materially affect the nature or quality of the course and which do not affect the course accreditation. You acknowledge and agree that all course material, programme material and copies of such and all intellectual property rights in such materials (including but not limited to copyright) are the property of the relevant training provider.

Neither you nor your substitute delegate will copy and/or distribute the whole or any part of those materials without prior written consent. Some courses require compulsory periods of private practice outside of the classroom, building upon and developing techniques and skills, ensuring that such techniques and skills have been mastered before continuing on to the next classroom module.

If you fail to demonstrate that you have an adequate level of competency (including, but not limited to, providing evidence that you have undertaken sufficient practical experience), without incurring any liability whatsoever to you, the trainer reserves the right to exclude you from attending subsequent classroom sessions. If you are excluded from completing the course you will fail the course and you will not be entitled to a refund of the course fee nor be permitted to re-schedule. You may be permitted to re-sit the course at the sole discretion of the relevant training provider.


Course Pre-requisites

Please ensure you comply with the relevant pre-requisites as detailed in the Course Information Sheets. Where you are required to bring your own hairdressing products, this includes but is not limited to brushes, combs, gowns and hairdryers. When bringing electrical equipment (not limited to hairdryers, clippers and hair straighteners), it is your responsibility to ensure that it has a safety certificate (complying with the Electrical Safety at Work Regulations under the Health and Safety Act).

Where you are required to bring a model you must ensure they are over 18 years of age and that they have completed and signed a Model Indemnity Form (available on the day of your face to face training). If you are acting as a model you will be required to sign a Model Indemnity Form as a course prerequisite.

Where any colour is being applied, in accordance with the relevant manufacturer’s instructions, you must ensure that the colour product is skin tested on your model at least 48 hours before the course. We reserve the right, without incurring any liability to you (including no obligation to refund the course fees), to exclude you from taking part in the practical aspects of the course if you fail to comply with the course pre-requisites which could result in you failing the course.

Where the course requires you to allow other candidates to work on your nails, it is your responsibility to ensure that your nails are in good, healthy condition. By signing up to the course you confirm you have never suffered from an allergic reaction, sensitivity or any other medical condition as a result of or arising from a nail treatment. Our trainers reserve the right to exclude you from attending a course if the educator reasonably considers that your nails are in poor and unhealthy condition. If excluded you will not be entitled to a refund nor be entitled to re-schedule to another course or date.

We reserve the right to reject you from attending a course where we reasonably suspect that you are under the influence of drugs and/or alcohol, without incurring any liability to you. If excluded you will not be entitled to a refund nor be entitled to re-schedule to another course or date.

IMPORTANT: You warrant and confirm that you have the required level of experience and/or qualification to attend and participate in the course you have booked. We reserve the right to reject you from a course where we discover you are not qualified without incurring any liability or obligation to you. If rejected from a course, you will not be entitled to a refund of the course fees paid or any expenses incurred by you in attending the course from which you were rejected.


Cancellation and Refunds

In-store courses are refundable up to 8 days prior to the date of the course. After this point courses are NON-REFUNDABLE and NON-TRANSFERABLE under ANY circumstances. You may send a substitute delegate providing s/he meets the course criteria. We reserve the right to cancel the course date, in this case we will notify you 7 days prior to the event and advise you of an alternative date/venue or provide you with a full refund. In the event of a course cancellation under 7 days’ notice, a new course date or refund will be organised for you, however in this instance Capital Hair & Beauty are NOT liable for travel expenses, child care, potential loss of income or any potential associated costs.

If you have booked an online course or a course with access to the online learning portal, no refunds will be issued in any case should the online learning portal be accessed as this contains all the course information including video tutorials for you to be able to perform the treatments.

If you fail to attend a booked course of your choice you will not be entitled to a refund or offered an alternative course. This applies to all courses. If you have failed to attend a face to face session/in-store course because of a medical condition, we may at our absolute discretion, on being presented with a valid medical certificate, offer you a place on an alternative course of equivalent value, subject to availability. We may, at our absolute discretion, agree to accept a substitute delegate in your place subject to your delegate having the required experience and/or qualification. A substitute will be required to sign a declaration that they accept these Terms and Conditions before attending the course, failing which they will not be permitted to attend the course and we will have no further obligation or liability to you.

We reserve the right to cancel any course or course venue at any time at our absolute discretion. Where we cancel a course we will attempt to notify you as soon as possible in writing or by telephone or by email, and together with our training provider will use all reasonable efforts to re-schedule an alternative course or date for you. Our total liability to you for cancelling a course or course venue will be limited to a full refund of the course fees paid by you.

We will NOT be responsible for any losses, costs and expenses you may have incurred including but not limited to model fees, accommodation costs, childcare, wages and loss of earnings.


Liability

It is your responsibility to ensure that your existing insurance policies cover your attendance and participation on the course and that any new certificate gained through completion of a course will be covered by your existing or new insurance policy.


Data Protection

We are committed to preserving the privacy of our customers. We may use your personal data for administrative purposes and we may keep this information for a reasonable period. We may also contact you by post, email, SMS or telephone to let you know about any products or services or special promotions that we think may be of interest to you. You will be given the opportunity to opt out of receiving marketing communications on each occasion.

We may also share your personal data with companies within our group some of whom may be located outside of the EEA and with our third party training providers in relation to the courses offered in this Training Prospectus, on the basis that they will not divulge your details with other third parties. We may also disclose or share your personal data in order to comply with any legal obligation or to protect the rights, property, or safety of our business, our customers or others. This includes exchanging information with other companies and organisations for the purpose of fraud protection, credit risk reduction and criminal investigations.


General

We reserve the right to vary these Terms and Conditions at any time. If any provision of these Terms and Conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.

All courses are subject to availability.

Certificates of completion will be sent to you by email upon successful completion of the course. For blended courses run by TRAINING SOLUTIONS GROUP, you will be able to access on your online portal to download your certificate.  You will have access to your online portal for one year, after this time TRAINING SOLUTIONS GROUP LTD will remove you from their learning management system. Any dispute or claim in relation to a course booked in the United Kingdom shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English courts. None of these Terms and Conditions shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a third party other than any substitute delegate of yours.

Pricing

We reserve the right to correct any pricing errors on the site at any time. All purchases are subject to availability and Capital Hair & Beauty reserves the right to refuse to supply to any individual or company for whatever reason.

All prices are exclusive of VAT and delivery and are quoted in Pounds Sterling unless otherwise stated.

Special offers

Special offers are subject to availability (while stocks last) and may change without notice. In-store offers may not be available online; online offers may not be available in-store. When a free or discounted product is issued as part of a special offer, this must be returned or full selling price paid if the qualifying product is returned as unwanted. Salon Furniture & Equipment, Training Courses, Olaplex, ghd, College Kits and shipping are excluded from any discount or promotional codes.

VAT Free Discount terms and conditions:

Our VAT Free equivalent discount means the total payable is the pre-VAT total of the merchandise. You will still be charged VAT (that's the law!) but the total amount you pay is as if we had not charged it. For example, if a product costs £10.00 +VAT the total you pay is £12.00. When we have a VAT Free Sale, we discount the price down to £8.33 +VAT so the total you pay is £10.00, which is the same as the original price, but without the VAT. Minimum spend of £20 +VAT applies.

Please ensure you have entered any promotional codes before checking out, as discounts can not be applied retrospectively to an order.

Store VAT Free Open Days: Subject to a £40+VAT minimum spend. This VAT Free offer means the total payable is the pre-VAT total of the merchandise. This offer cannot be used in conjunction with Privilege Points, 4+1 promotions, Salon Furniture & Equipment or College Kits. VAT Free promotion is available in selected participating Capital stores only. Please refer to marketing communications for details. Open to personal callers only & does not apply to Click & Collect orders. If you’re VAT registered you can still reclaim your VAT!

Freelance Focus terms and conditions:

This offer is on selected full price products only and cannot be redeemed in conjunction with other selected promotions or against furniture, training courses and ghd. Only one use per customer. This code will be valid for a maximum of 6 weeks and will end on 15/12/23 at 11.59pm.

10% off PARLOR Furniture:

This offer is available on Parlor furniture only and cannot be redeemed in conjunction with other promotions on our website or in-store. Privilege Points are not available to be used on furniture. This code will be valid for a maximum of 6 weeks and will run from 20th February – 1st April 2024.

Cancellation and amendment of orders

We're sorry that in most circumstances it's not possible to make changes to your order once you've placed it. If your order has already been dispatched from the warehouse, then you'll need to return any unwanted items following our returns procedure

If your order hasn’t yet been processed by the warehouse, we may be able to change delivery address details, remove items from your order or cancel it completely. Cancellation and amendment of orders cannot be done outside business hours.

Payment

We accept payment via the following methods: Visa, MasterCard, American Express, Apple Pay, Google Pay or PayPal.

You can also pay by BACS, please contact us prior to placing your order to arrange payment by this method. Payment in full (cleared funds) required before any goods are dispatched. BACS payment charges (if applicable) must be paid by sender of funds.

Delivery

We aim to dispatch orders within 1 - 2 working days however this can vary due to stock availability. Furniture and equipment orders are normally delivered within 2 - 4 weeks although some items may take up to 18 weeks. Please note: All large furniture items are delivered to the kerbside only. You will be advised of the estimated delivery date shortly after your order is placed. Please arrange for appropriate help to be available to take larger/heavier items into your salon or home address.

We use a courier ‘next working day’ delivery service for all orders dispatched by us to UK mainland addresses (some larger orders are sent direct from manufacturers). Delivery times to European destinations are usually between 3 – 8 working days. Delivery times are quoted in good faith and we cannot accept liability for any expenses or other costs incurred due to failed or late deliveries. Delivery of overseas orders may be affected due to political conflicts, such as war, civil unrest, martial law etc.

Please note that in some circumstances the delivery surcharge may need to be increased for large and/or bulky items either inside or outside of the United Kingdom. However you will be informed of this before your order is dispatched.

We accept no responsibility for late, missed or failed deliveries as these are carried out by courier companies on our behalf. Orders requiring more than 1 parcel may be split by the courier resulting in multiple deliveries. Parcels may also be left with a neighbour, at a post office or parcel shop if you are not in, for you to collect at a more suitable time (opening times apply).

Delivery times may vary from standard business hours. Our couriers deliver up to approx. 7pm, but may go beyond this during busy periods.

You may be charged a redelivery fee if you are unable to accept a delivery, and the goods are consequently returned to the depot. To avoid this please ensure you are available to accept a delivery on the day(s) quoted and arrange for any additional help you may require to take larger items into your premises.

Sorry, we cannot deliver to BFPO addresses.

Free delivery offer

Applies to orders placed online totaling £50 +VAT or more for delivery to UK mainland (excluding Rural Scotland); training courses, college kits & delivery charges do not count towards the free delivery threshold. Orders over this amount that include furniture or equipment will be subject to a surcharge. This will be advised dependent on the item in question.

Next day delivery service 

Orders placed online before the advertised cut-off time may be eligible for next day delivery, this applies to orders placed Monday to Thursday on working days only. Orders placed prior to the advertised cut-off time on Friday will usually be delivered on the Monday. This service is subject to stock availability and does not apply to orders including furniture, equipment or special order items. Where the next working day is a bank holiday, goods will be out for delivery on the following working day. Please note the cut-off time for next day delivery is subject to change without notice, the estimated delivery date will be displayed on the website.

Delivery notification service (including 1-hour delivery time slot)

In order to keep you up-to-date and to deliver your goods at the most convenient time for you, we'll pass your email address and mobile number (where provided) on to our courier company so they can email you throughout the various stages of delivery and/or text you when a delivery is due to be made. These messages will also include a 1-hour time slot where delivery is estimated to take place and will give you the opportunity to delay your delivery for between 1 - 3 working days if more convenient for you. Please note that this service is only available for goods dispatched by us through our courier companies (DPD or Parcelforce) to UK addresses. A similar service is available to selected European countries through DPD, please see details below.

Delivery to European destinations

Prices quoted at checkout are for mainland areas of the delivery country only. In some circumstances the standard delivery charge quoted may need to be increased to allow for large and/or heavy items, however you will be informed of this before your order is dispatched.

DPD - Cross Border Predict service is now available to the following countries: Belgium (2-6 hour time slot), Czech Republic (3 hour time slot), Germany (2-6 hour time slot), Luxembourg (2-6 hour time slot), Netherlands (1-4 hour time slot) & Slovakia (3 hour time slot). This means that a delivery time slot notification will be sent to customers by text message (if phone number provided) or email.

Damaged, incorrectly delivered or missing goods

We take great care to ensure all goods you receive are correct and undamaged. However, in rare cases where incorrect/damaged goods are received or goods listed on the delivery note are missing please inform us within 48 hours of delivery (using the form below). We are not liable for any loss of earnings or other costs incurred due to damaged or incorrect products received, or items missing from deliveries.

We’ll begin an investigation immediately and contact you with the next steps. You will be reimbursed the cost of delivery if required to send anything back to us, but please note photos will be requested for damaged items.

Product restrictions

Please note we cannot send aerosols, flammable or hazardous items to overseas destinations. Please do not order any restricted items if delivery is to an overseas destination.

Customs

When purchasing goods for delivery outside the United Kingdom you may be subject to import duties and taxes which are levied once the goods reach the specified destination. You are also liable for any additional customs clearance charges, we have no control over these charges and cannot predict what they may be. If you are ordering goods for delivery outside the United Kingdom it is your responsibility to comply with all laws and regulations of the countries the goods will travel through and where delivery is to be made.

Your online account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account. If you believe that your password has become known to anyone else, you must inform us immediately.

Password Policy: Minimum 8 Characters (inc. 1 upper, 1 lower case and 1 numeric)

Ownership of goods

We will retain ownership of the goods you order until we receive full payment for the order including any applicable delivery charges. Once the goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Returns

Unwanted goods

Returning goods bought online is not a problem, all we ask is that they're returned within 28 days of delivery, unused, in perfect condition and in their original packaging. Goods returned to us that do not meet these requirements will be sent back to you at your cost (normally our standard delivery charge).

Therefore, please inform us of your intention to return goods prior to dispatch.

Please return goods to the address shown below (returns cannot be processed in-store without prior authorisation) and ensure a copy of your invoice/receipt accompanies the return. We strongly recommend that you use some form of recorded delivery and that goods are securely packaged and insured as we cannot accept any responsibility for lost or damaged goods.

If you’re unable to send goods back to us we may arrange a collection however the cost of this will be deducted from any refund due. Collections usually cost around £15+VAT, you may need to pay in advance if the refund due does not cover this. The original delivery charge cannot be refunded. Furniture and equipment orders may be subject to additional conditions, please see below for details.

Due to health and safety regulations we cannot accept returns (subject to our discretion) of the following products if the packaging has been opened:

  • Scissors/Razors
  • Cosmetics
  • Hair brushes/Hair extensions
  • Body jewellery/Piercing tools
  • Foot Spas

This list is not exhaustive and does not affect your statutory rights.

Faulty or incorrectly delivered goods

We take great care to ensure all goods you receive are correct and undamaged. However, in rare cases where incorrect or damaged goods are received please inform us within 48 hours of delivery. Please see our contact details page for ways to get in touch. We’ll arrange collection of the goods (at our cost) and send out replacements as soon as possible. If it is more convenient for you to send the goods back to us, let us know and send to the address below using recorded delivery and we’ll reimburse you the cost of this. Please note that refunds cannot be processed in-store without prior authorisation.

For items returned due to a fault that has developed within the manufacturers warranty period, a repair, exchange or refund (including the original delivery charge where applicable) will be offered once the fault has been confirmed. In cases where the fault (or cause of the fault) is not apparent we reserve the right to send the item for testing. This will usually be carried out by the manufacturer and their response will be required before any actions can be taken. We will notify you of the outcome and options available. If a manufacturing fault is not found the item will be sent back to you at your cost (normally our standard delivery charge).

Furniture and equipment items

Most furniture and equipment items are built to order or custom built; these items are subject to the following additional terms of cancellation or return:

Furniture and equipment orders cannot be cancelled more than 5 working days after being placed, we may in rare circumstances accept the cancellation or return of an order outside of this time scale however this is at our discretion and may be subject to a charge of up to 20% of the value of the goods as well as the delivery charge.

Price match (in-store only)

Our price promise guarantees you: the lowest price available within the local area. If you can purchase the same product and brand at a cheaper price than ours WE WILL MATCH THE PRICE. We only ask that the same product is immediately available at a local supplier (within 5 miles of the store) and that the goods are in factory sealed packaging. Our price promise applies where the price on offer can be verified by written evidence (advert or flyer). We are unable to accept hand written offers and will not apply the Price Promise to other Capital exclusive offers. We do not match mail order, internet companies or VAT free promotions.

Price match (Salon Furniture)

We will match a competitors’ price on branded salon furniture*. Items must be:

  • New, identical, and offered on the same terms.
  • Quoted in the last 7 days
  • Supported with evidence of pricing and stock availability, (quote, or screenshot of competitors’ web listing which can be verified)
  • Delivery charges or other services are excluded.

Our Price Match Promise cannot be used with any other offer including VAT FREE promotions.

All Price Matching requests must be made by email to furniture@capitalhb.co.uk prior to ordering, payment will be required in full on placement of your order.

*Price matching is at our discretion, we reserve the right to refuse to match a price.

Jurisdiction

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.

Force majeure

Capital Hair & Beauty shall be entitled to cancel or delay delivery of orders if it is delayed, hindered or prevented from delivery through circumstances beyond its control. Such circumstances shall include (but are not limited to) industrial action, accident, fire, act of god or failure to deliver by suppliers or couriers.
